When a child needs to be cared for by someone other than a parent, a probate guardianship gives that adult legal authority. It’s common when a relative steps in to raise a child. Here’s the California process.
Guardianship of the person vs. the estate
Guardianship of the person covers the child’s care and custody; guardianship of the estate manages the child’s money or property. You can request one or both.
How to file
File the Petition for Appointment of Guardian (GC-210) and child-information attachment in the child’s county, give formal notice to the parents and close relatives, and cooperate with the court investigator.
The hearing
If the court finds guardianship serves the child’s best interest, it issues an order (GC-140) and Letters of Guardianship (GC-150). Guardianship does not permanently end parental rights the way adoption does.
