When an adult can no longer care for themselves or manage their finances, a conservatorship lets a responsible person step in. Here’s how conservatorship works in California.

Two types

Conservatorship of the person handles daily care and medical decisions; conservatorship of the estate manages finances and property. A court can grant one or both.

How it works

You file a petition (GC-310) in the probate court, give notice to the proposed conservatee and relatives, and a court investigator reviews the situation. The proposed conservatee has the right to attend and object.

Consider alternatives first

Conservatorship is significant — courts prefer less-restrictive options like a durable power of attorney or advance health care directive when those were set up in advance.
